MTRH Sensitizes Staff on Sexual Offences Act
Staff at the Moi Teaching and Referral Hospital have been sensitized on handling victims of sexual offences.The Sexual Offences Act (SOA) was passed by the National Assembly on 31st May, 2006 and was assented to on 14th July, 2006 and was operationalized on 21st July, 2006.The Act deals with both male and female victims.
While making a presentation to the Hospital staff on August 1st, 2012 at the Riley Mother and Baby Hospital (RMBH), a legal assistant with GIZ, a German Technical Cooperation, Ms. Brenda Oduor, said that contrary to popular belief it is not a law for women to fix men.
She said that it is only the Attorney General who has powers to stop cases of sexual offences.
Brenda defined rape as: “any sexual intercourse without consent or where the consent is obtained by force or by fraudulent means or threat or intimidation.”
Attempted rape, on the other hand, is defined as an attempt by any person to unlawfully and intentionally commit an Act that causes penetration with his or her genital organs (penetration can be partial or complete).
She said that police cite language/cultural barriers and taboos as challenges, failure of victims to report sexual offences, inability to draft charge sheets, lack of witness protection and potential witnesses.
The Hospital has a Centre for Assault and Recovery-Eldoret (CAR-E) that deals exhaustively with such cases, free-of-charge with the support from GIZ.
